Muitos sistemas jurídicos adotaram normas que acarretam a exclusão de provas tenham sido obtidas com violação regras procedimentais. A normalmente ocorre antes do início processo ou mesmo durante o seu transcorrer. Contudo, maioria dos casos criminais atualmente não são resolvidos por meio um completo, mas alguma espécie procedimento abrevia, exemplo, acordo penal uma ordem em decreto.
